Understanding mental capacity and the law

The Mental Capacity Act governs all situations where there are questions about whether a person has the capacity to make a choice or decision about their life. This course will help you to understand the principles that you need to apply when deciding whether or not a person has the capacity to make a particular decision. It will also look at how to obtain lasting power of attorney, the Court of Protection and how to obtain information on behalf of persons lacking capacity.
In particular the course will include:

- The main provisions of the Mental Capacity Act 2005 and the principles considered in determining whether a person has the capacity to make a particular decision.
- - The role of the IMCA
- the various mechanisms for substitute decision making, including the new ‘Lasting Powers of Attorney’ - The new Court of Protection ‘deputies’ and appointeeships
- - Issues of confidentiality and access to information on behalf of persons lacking capacity
